04.03.2025 Sl. No.: 33 Court No.30 BM WPA 22627 of 2015 Supravat Das Vs.

The State of West Bengal & Ors.

Mr. Sk. Abu Abbas Uddin Mr. Ashis Santra Ms. Nahid Rahman Mr. Amit Ganguly ... for the petitioner Mr. Panna Lal Bandopadhyay ... for the State Mr. Dhiman Kumar Sengupta Ms. Farhin Mustaque ... for the respondent no.2 1.

The present writ application has been preferred by the petitioner herein praying for direction upon the respondents Tamluk Ghatal Central Co-operative Bank Ltd., Brajalalchak Branch to absorb the petitioner in the Group-'D' posts.

2.

It is the case of the petitioner that he was working as Water Carrier-cum-Sweeper in the said branch on daily wages of Rs.100/- till 25.11.2014 on which day he was removed from the said work. 3.

The petitioner was working in the Bank since 10.04.2013. The petitioner now has prayed for absorption to Group-D posts. Admittedly, the post of a water carrier-cum-sweeper is not a sanctioned post and no regular employees are employed in the said post.

4.

Considering the said fact, the prayer of the petitioner to be absorbed as a Group-D staff is beyond scope of regularisation.

5.

The writ application is thus disposed of with the direction that the petitioner can avail of the facility if and when any regular recruitment process is undertaken by the authority concerned in respect of the said posts, if he meets the required qualification and succeeds in the examination, on competing with other candidates.

6.

The writ petition stands disposed of.

7.

Urgent Xerox certified copies of this order, if applied for, shall be supplied to the learned counsel for the parties as expeditiously as possible, in compliance of usual formalities.
