Despite compliance of all formalities by the petitioner, who is an occupier of the premises-inquestion, the CESC Limited could not give a new electricity connection to the petitioner due to resistance by the private respondents/alleged landlords.

Learned counsel for the CESC Limited corroborates such contention.

Since despite service none appears for the private respondents at the time of call, the matter is taken up for hearing in their absence by keeping on record the affidavit-of-service which is filed today.

In view of the above circumstances, WPA No.

22765 of 2023 is allowed, thereby directing the

CESC Limited to give the electricity connection to the petitioner within 48 hours from now. In the event any obstruction is raised by the private respondents, it will be open to the CESC personnel to approach the respondent no.3, the Officer-in-Charge, Topsia Police Station for adequate police assistance which will be given at the cost of the petitioner by acting on a server copy of this order, if necessary, by removing any padlock or other hindrance put up to resist the CESC personnel in giving such connection. The new connection shall be given from the existing meter board position at the premises.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
