The petitioner complains that the private respondents threaten and intimidate her to leave her premises. The private respondents are promoters, who wish to take the premises over for construction of a building.

On the first complaint of the petitioner, Berhampore PS has registered FIR No.1089 dated 23rd August, 2022. At the instance of the petitioner, two further complaints have been registered by the police, but that have not resulted in any proceedings or formal FIR being registered.

This Court is of the view that the investigation into the aforesaid FIR must be completed mandatorily and positively within a period of one month from date, if not already completed.

In respect of other two complaints of the petitioner, she may approach before the concerned Magistrate under section 156(3) of the CrPC or she may

take out any other civil proceedings against the private respondents in accordance with law.

Berhampore PS shall, however, ensure that there is absolutely no breach of peace in the area and the petitioner shall not threaten by the private respondents. 6.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
