1. Petitioner submits the opposite party-wife has remarried. Accordingly, he prays for setting up execution proceeding. Execution proceeding is pending before the Magistrate.

2. It is open to the petitioner to agitate these issues before the Magistrate and pray for modification of the maintenance allowance granted to opposite party-wife in accordance with law. Unless the maintenance allowance is modified, execution proceeding cannot be dropped.

3. With this observation, application being CRR 4031 of 2024 is dismissed.
