Ms. Salma Sultana Shah Mr. Sani Hossain Ms. Sneha Sarkar ..for the petitioner Mr. Lalit Mohan Mahata Mr. Jagabandhu Roy ..for the State The petitioner challenges election of one Husanara Khatun as a member of Mahanandapur Gram Panchayat, Malda. The elected candidate has not been made a party to this writ petition.

In any event, such an election dispute has to be adjudicated by the competent Civil Court in terms of Section 79 of the West Bengal Panchayat Election Act, 2003.

In that view of the matter, I am not inclined to entertain this writ petition.

Accordingly, WPA 22792 of 2023 is dismissed.

Needless to mention that dismissal of this writ petition will not prevent the petitioner from pursuing the statutory remedy if she is entitled to do so in law.
