The petitioners have assailed the order passed by the learned Additional Chief Judicial Magistrate, Chanchal, Malda, on 16th February, 2024 in G.R. 2328 of 2022 directing issuance of warrant of arrest against the petitioners.

The petitioners were granted anticipatory bail on 20th December, 2022 in CRM(A) 5908 of 2022. They failed to appear before the learned Magistrate on 21st November, 2023 due to wrong posting of date in the diary of the law clerk. They also did not appear before the learned Magistrate on the next date fixed on 16th February, 2024 for which warrant of arrest was issued against them. The petitioners undertake to surrender before the learned Magistrate by 7th October, 2024.

If the petitioner surrenders before the learned Magistrate within 7th October, 2024, the learned Magistrate shall allow them to remain on the same bond.

Warrant of arrest issued against the petitioners be stayed till 8th October, 2024.

In the event if the petitioners fail to surrender before the learned Magistrate within the stipulated time frame, the learned Magistrate shall be at liberty to take necessary steps in accordance with law without further reference to this Court.

Accordingly, CRR 4037 of 2024 is disposed of.
