The petitioner no. 1 Narayan Chandra Pal to have expired on 7.2.2019 supported by a death certificate and the said death certificate be kept with the record. Under such circumstances, the appeal gets abated against the petitioner no. 1.
Learned advocate for the petitioners filed a fresh Vokalatnama in court, the same be kept with the record. The petitioners Smt. Niyati Pal, Swapan Kumar Pal, Smt Namita Jana , Khudiram Jana and Krishna Prasad Mondal are present before this court. Their personal appearance is noted and dispensed with.
Learned advocate for the petitioners submits that the petitioner no. 2 is seriously ill and his medical report to that effect has filed in court, let the same be kept with the record. He further submits that the petitioner no. 3 is a labour
working at Bangalore and seeks his personal appearance in this court be dispensed with.
Accordingly, his personal appearance before this court is dispensed with.
Learned advocate for the petitioner further submits a written instruction that the petitioners do not want to proceed with the instant revisional application. Let the written instruction be kept with the record.
Under such circumstances, the instant revisional application is dismissed for non-prosecution. The order dated 14.12.2011 passed by this court is vacated.
Department is directed to communicate this order to the learned trial court through the learned Registrar Judicial Service immediately for information.
