The petitioner seeks transfer from the School where she is presently posted. To that effect, she has prayed before the Commissioner of School Education vide letter dated August 1, 2024. The same is yet to be considered by the said respondent.

The petitioner's case has a chequered history. In response to her first application for transfer, she was transferred to a school which did not have the sanctioned post to accommodate her.

After much wear, she was transferred from there to the present School which is at a faraway place from her residence. The petitioner's difficulty is that she has to take care of her ailing husband suffering with serious disease and a minor child back in home. According to the petitioner, her transfer to a nearby school is extremely essential for her to maintain her livelihood and also the family.

Having heard the learned counsels for the parties and after perusal of the record, it is found proper to dispose of the writ petition with a direction upon the respondent/ Commissioner of School Education, Government of West Bengal, to immediately take up the representation of the writ petitioner dated August 1, 2024, for consideration and decision upon the same. Let a reasoned order be passed by the Commissioner of School Education, Government of West Bengal, to dispose

of the petitioner's prayer as above, if not the same is immediately allowed by the said respondent. In case the same is allowed, let the said respondent issue appropriate letter to the respondents/School Service Commission, for the necessary follow up action.

In doing so, the said respondent shall afford opportunity of hearing to the petitioner and decide about the prayer of the petitioner vide letter dated August 1, 2024, within a period of two weeks from the date of communication of copy of this order.

7. With the above observations and directions the writ petition being WPA 23627 of 2024 is disposed of.

8. Since no affidavit is invited, the allegations contained in the petition are deemed to have been denied by the respondents including the private respondents.

9. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
