Mr. Sobhan Majumder ...for the Petitioner Mr. Sandipan Banerjee, Mr. Amanulla Molla, ...for Birbhum Zilla Parishad 24-07-2024 AKG Ct. 15 The petitioner was entrusted with a work order for "construction of multivented box bridge over stream namely Sidheswari in between vill.-Joypur & Goabagan within Rajnagar PS area (Phase-II) under JAP fund" by Birbhum Zilla Parishad. The value of the work order was Rs. 43,93,103/-.

It is the grievance of the petitioner that though he has successfully completed the work, a sum of Rs. 21,75,142/- remained unpaid. The petitioner also submits that the Birbhum Zilla Parishad has issued a completion certificate.

On behalf of the Birbhum Zilla Parishad, it is submitted that the petitioner could not complete the work within the stipulated time period. It is, however, not disputed that the petitioner completed the work. It appears that the petitioner has made a representation dated June 6, 2023, before the Birbhum Zilla Parishad appearing at page 21 of the writ petition for release of his unpaid dues.

In the aforesaid facts, I dispose of this writ petition with a direction upon the Birbhum Zilla Parishad to consider the representation of the petitioner dated June 6, 2023, appearing at page 21 of the writ petition within a period of one month from the date of communication of this order and a reasoned order should be communicated to the petitioner within a period of one-week thereafter. Accordingly, WPA 22803 of 2023 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
