Report submitted by the State is taken on record. Learned counsel for the petitioner submits that the petitioner is pressing only prayer b and does not intend to press other prayers. Learned counsel submits that the other prayers have been complied with.
Prayer b of the writ petition is as follows:
"b. Issue a Writ of Mandamus and/or in the nature of Mandamus directing thorough, impartial, independent and transparent investigation into the Kaliganj P.S. Case no. 534 of 2025 by any independent agency."
Though the petitioner verbally seeks transfer of the investigation to an independent agency, the prayer in the writ petition does not indicate so.
Learned counsel for the State submits that chargesheet has been submitted against 10 accused persons. The case has been committed and witness action has commenced before the learned Sessions Judge. Upon holding further investigation, supplementary charge sheet has also been filed.
Upon consideration of the material on record, this Court is of the view that since there is no prayer for transfer of investigation to an independent agency and also in the opinion of this Court the case has been investigated in a fair and unbiased manner, there is no necessity for transfer of the same to any independent agency, more so since trial of the case has proceeded.
No fruitful purpose shall be served by keeping the writ petition pending.
The writ petition is accordingly disposed of. There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
