C.R.M.(A) 4307 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Khardah Police Station Case No. 402 of 2023 dated 23.6.2023 under Sections 448/427/341/324/308/34 read with Section 304 of the Indian Penal Code.

...... petitioners Mr. Koustav Bagchi Mr. Debayan Ghosh Ms. Priti Kar ....for the petitioners Mr. Swapan Banerjee Ms. Purnima Ghosh ....for the State The application for anticipatory bail is taken up for consideration subsequent to the order dated October 16, 2023 passed by the Coordinate Bench.

By such order dated October 16, 2023, the petitioners were enlarged on an interim anticipatory bail. It is submitted at the bar that, the order granting interim anticipatory bail was passed just prior to the ensuing puja vacation without considering the materials in the case diary. Commissioner of Police and Investigating Officer are present in Court.

Learned advocate appearing for the State submits that provisions of Section 302 of the IPC, 1860 were added and that the petitioners were arrested.

In view of the arrest of the petitioners, C.R.M. (A) 4307 of 2023 is dismissed as infructuous.
