1. It is submitted on behalf of the petitioner that considering the fact that the present accused petitioner has been falsely implicated in the instant case and also considering the long detention of the present accused petitioner, the instant bail application may be considered favourably.

Learned advocate for the State opposes the prayer for bail. It is submitted that the present accused petitioner is the sole accused and at present, the recording of evidence of the victim boy (the vulnerable witness) is going on.

Considering the serious nature of crime and also considering the fact that as on this date, the evidence of the victim boy has not yet been completed, we are not inclined to exercise our discretion under Section 439 of the Code of Criminal Procedure/Section 483 of the BNSS. The prayer of the petitioner for bail is considered and rejected. Signed By :
