It is surprising that although the authority being the Executive Engineer, PWD, Purba Medinipur Electrical Division, Government of West Bengal, accepts the dues of the petitioner, no steps have yet been taken to release the same. Only part payment of Rs.31,63,143/- has been made.

The Executive Engineer, PWD has admitted that the balance of the demand would be paid to the petitioner once the money is received from the competent authority. The report indicates that the competent authority has been reminded for release of the funds.

This Court finds it surprising that the authorities have maintained a silence by not doing its duty and discharging its obligation to pay the petitioner the

balance amount, which has forced the petitioner to approach this Court.

Under such circumstances, the writ petition is disposed of with a direction upon the competent authority to release the balance amount in favour of the Executive Engineer, PWD, Purba Medinipur Electrical Division, not later than November 15, 2024 and the Executive Engineer, PWD, shall make the onward payment to the petitioner within two weeks thereafter.

The order shall be treated as mandatory, as there is no denial by the authorities with regard to the claim of the petitioner.

The writ petition is, thus, disposed of.

There shall be no order as to costs.
