Ms. Salma Sultana Shah Mr. Sani Hossain Ms. Sneha Sarkar ..for the petitioner The petitioner challenges election of a Panchayat member of Rashidabad Gram Panchayat, Harishchandrapur Block-I, District - Malda. The elected candidate has not been made a party to this writ petition.

In any event, such an election dispute has to be adjudicated by the competent Civil Court in terms of Section 79 of the West Bengal Panchayat Election Act, 2003.

In that view of the matter, I am not inclined to entertain this writ petition.

Accordingly, WPA 22806 of 2023 is dismissed.

Needless to mention that dismissal of this writ petition will not prevent the petitioner from pursuing the statutory remedy if he is entitled to do so in law. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
