Mr. Shiv Chandra Prasad ..for the P.F. Authority The Employees Provident Fund Organisation (in short EPFO) the respondent no.1 in this writ petition and its officer the respondent no.2 are represented. The petitioner remains unrepresented.

The petitioner had challenged an order dated 3rd April, 2009 passed in an appeal under Section 71 of the Employees' Provident Fund & Miscellaneous Provisions Act ( in short EPF Act) by the learned Employees Provident Fund Appellate Tribunal by which the petitioner was directed to deposit 40% of the assessed amount under Section 7A of the EPF Act.

It appears from the record that the matter appeared in the list on 27th September, 2012 when the respondent nos. 1 and 2 were represented but the petitioner remained unrepresented even on the second call for which the writ petition was directed to go out of

the list. The petitioner has not taken any steps to argue the writ petition since then.

It appears that over the passage of time the writ petition has become infructuous and as such the petitioner is not willing to prosecute the writ petition. The writ petition is accordingly disposed of without any order. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance of all necessary formalities.
