Mr. Srijan Nayek Mr. Arijit Dey ... for the Kolkata Municipal Corporation The petitioner is aggrieved by the notice issued under Sections 544 and 546 of the Kolkata Municipal Corporation Act, 1980.

The Executive Engineer (B) issued the said notice in compliance of the direction passed by the Senior Municipal Magistrate affirming the order passed by the Municipal Magistrate.

Learned advocate representing the Kolkata Municipal Corporation submits, upon instruction that, the order of the Municipal Magistrate has already been acted upon and part demolition of the unauthorised construction has already been carried out.

It appears that there is no apparent error on the part of the Executive Engineer in acting in accordance with the order passed by the Court.

In view of the above, no relief can be granted to the petitioner in the present writ petition.

It will be open for the petitioner to assail the order of the Senior Municipal Magistrate before the competent forum, if so advised.

Writ petition is disposed of.
