None appears on behalf of the appellant, nor any accommodation is prayed for on behalf of the appellant. The appellant was also not represented on 17.11.2021. On earlier occasion we have given opportunity to the appellant to remove the defects. The Stamp Reporter in 26.09.2016 has observed that the delay about 41 days in preferring the appeal. However, the appellant is not present to remove the defects. In view thereof the application being CAN 9929 of 2016 is dismissed for default.

In view of the dismissal of the said application is time barred and accordingly the appeal along with connected application are dismissed.
