The petitioners are primary school teachers who got admitted for obtaining two years D.El.Ed. training course in the session 2024-2026 in the Government recognized private self-financed institution. Their grievance is that the order of release is not being used by the Council in their favour for which they may not be in a position to attend the training course. It appears that a representation has been filed by twelve petitioners before the Chairman of the Council

with a request to issue recommendation/order for deputation. The same has not been acted upon till date. Learned advocate representing the Council submits, upon instruction that, the petitioners did not submit any document evincing their admission in the D.El.Ed. course. Without the documents the Council is not in a position to issue any release order in favour of the teachers.

The instant writ petition is disposed of by granting leave to the petitioners to forward the documents in support of their admission to the Chairman of the Council. On verification of their credentials and documents submitted by the petitioners, the Chairman shall take a decision for issuance of no objection certificate in their favour so that the teachers can attend the training course. Steps shall be taken in the matter at the earliest but positively within a period of two weeks from the date of receipt of all documents from the petitioners. The respondent no.6 has been wrongly impleaded. Respondent no.6 stands deleted from the array of respondents.

It is made clear that the instant writ petition is related to the district 24 Parganas (South).

Receipt showing deposit of deficit court fees be retained with the records.

Instruction forwarded by the Chairman of the Council be also retained with the records.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
