Petitioner is directed to serve a copy of the revisional application upon Mrs. Debjani Sahu, learned advocate who ordinarily appears on behalf of the State. Her appointment may be regularized by the concerned Authorities in due course. The present case arose out of the complaint made with Lake Town Police Station Case No. 115 of 2021 dated 08.06.2021. More than two years have passed since the initiation of the case and there has been no progress in the case since the chargesheet was submitted on June, 2021.
Record reflects that an application under Section 239 of the Code of Criminal Procedure is pending before the concerned jurisdictional court and the same is pending. It has been informed that the next date has been fixed by the learned trial court on 29th November, 2023. The learned trial court is directed to conclude the
hearing on the said date or within a fortnight thereafter. If after hearing the application under Section 239 of the Code of Criminal Procedure, the learned trial court is of the opinion that a case has been made out and the same should proceed for trial in that case the learned trial court would fix at least one date in every 60 days so that the case can be taken to its logical conclusion within a reasonable period of time.
. With the aforesaid observations, the present revisional application being CRR 3869 of 2022 is disposed of. Pending applications, if any, are consequently disposed of.
