Heard learned Advocates appearing for the parties. Petitioners have filed this writ petition seeking for relief of allowing the petitioners to install elevator in the building premises in question and it is the case of the petitioners that petitioners are old aged persons and facing health problem without elevator. Though the petitioners have made prayer for direction upon the Additional Registrar of Co-operative Societies/respondent No.3, to consider and dispose of their case and pass necessary approval for installation of elevator but Mr. Nayak, learned Advocate appearing for the State respondents fairly submits that the appropriate authority for granting relief in this matter is the Executive Engineer, Bidhannagar, Salt Lake, Kolkata/the respondent No.4.

Considering the facts and circumstances of the case and submission of the parties, this writ petition being WPA 23163 of 2022 is disposed of by granting liberty to the petitioners to make appropriate

representation before the respondent No.4 for seeking approval for installation of elevator, within two weeks from date and if such representation is made by the petitioners before the respondent No.4, he will consider and dispose of the same in accordance with law and by passing a reasoned and speaking order after giving an opportunity of hearing to the petitioners or their authorised representative, within a period of four weeks from the date of receipt of such representation.
