Heard learned counsels for the parties.

Learned counsel for the petitioner submits that respondent Nos.7 & 8 are not necessary parties to the writ petition and their names may be expunged. Accordingly, the names of the respondent Nos.7 & 8 be expunged from the cause title of the writ petition.

The grievance of the petitioner is that the cycle shop owned by the petitioner has been closed down illegally by the local goons. The cycle shop is the only source of livelihood for the petitioner. He is unable to make his both ends meet due to forcible closure of the said shop. The petitioner submitted a representation before the Superintendent of Police, Purba Bardhaman for taking necessary steps in this regard which has not been considered.

Learned counsel for the State submits that no complaint/representation was submitted by the petitioner before the Inspector in Charge of Ausgram PS under whose jurisdiction the shop is situated.

On prayer of the petitioner, liberty is granted to file an appropriate application before the Inspector in Charge, Ausgram PS, being the 6th respondent herein, by hand ventilating his grievance within a week from date. The 6th respondent is directed to consider the application and take necessary steps in accordance with law at the earliest, preferably within a fortnight from the date of receipt thereof, upon intimation to the petitioner.

The writ petition is accordingly disposed of However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
