AGP Mr. Parikshit Goswami ... for the State-respondent(s) The petitioner is aggrieved by the fact that the private respondents are blocking the road and when the petitioner resisted the same, he has been subjected to abuse, threatening of dire consequences as also aggression and adamant way of attempting to assault.

It is further alleged that in the passage rubbish and garbage is also thrown to block the petitioner's free egress and ingress.

The petitioner also complains that subsequently during the pendency of the writ petition, the petitioner has been subjected to further harassment. However,

since the same has not been brought by way of an Affidavit and earlier report submitted by Mr. Yusuf, learned advocate appearing for the State, reflects that State has already drawn up proceedings under Section 126/135 of the BNSS pursuant to the directions passed in WPA 16337 of 2024, I am of the view that the police authority has already taken appropriate steps, as such, the petitioner, if so advised in respect of the subsequent events of any harassment, threatening and/or assault, would approach the jurisdictional Magistrate by invoking the power under Section 175(3) and/or under Section 223 of the BNSS.

State has already been keeping a strict vigil, they would continue to keep surveillance and ensure that no breach of peace and tranquility takes place as also no untoward incident results because of the inimical relationship existing between the parties.

With the aforesaid observations, WPA 23567 of 2024 is disposed of.

Pending application(s), if any, is also disposed of.
