Raj Kr. Kundu v. Aditya Kundu & ORS.
FMAT 972 of 2015 14.
sg 15-11-2021 With CAN 1 of 2015 (Old CAN 9064 of 2015) Ct. 8 With CAN 2 of 2015 (old CAN 10020 of 2015) With CAN 3 of 2017 (old CAN 10716 of 2017) Raj Kumar Kundu
Versus
Aditya Kundu & Ors.
(Through Video Conference) The appellant is not represented even in the second call nor any accommodation is prayed for on behalf of the appellant. The appellant was also not represented on the earlier occasion. The matter was adjourned earlier in order to enable the department to trace out the connected applications. It appears that the application for condonation of delay was filed on 23rd September, 2015, however, the said application was never moved. The trial court has passed an ad-interim order of injunction by directing the parties to maintain status quo till the disposal of the injunction application. The impugned order by passage of time has lost its force as by this time, the injunction application must have been disposed of. In view thereof, this appeal and the connected applications have become infructuous by passage of time.
