IN THE HIGH COURT AT CALCUTTA

CIVIL REVISIONAL JURISDICTION APPELLATE SIDE CO 3601 of 2025 Sujan Kumar Sarkar

Versus

Kamalesh Chandra Roy & Ors.

Mr. Tanmoy Mukherjee Mr. Prasanta Bishal ...for the Petitioner

1. The revisional application has been filed against an order dated July 25, 2025, passed by the learned District Judge, Uttar Dinajpur, in Misc.

Case (Guardianship) NO. 37 of 2024. By the other impugned, the learned Court rejected an application for visitation filed by the petitioner, on the ground that the child was not willing to interact with the father. She was totally against any such meeting. In fact, the child had also made various accusations against the father. She was totally antagonistic towards the petitioner. The Court interacted with the child on various other topics as well, and found that the child was mature, rational and reasonable. She had clarity and understood the reason why the interaction with the court was arranged..

2. The fact that the child had an independent opinion was recorded by the learned Court. Moreover, a criminal

trial is also pending against the petitioner. The learned Court was of the view that the same may be prejudiced if visitation was allowed against the wishes of the child. On such grounds, the application was dismissed.

3. This Court is of the view that, neither any illegality nor perversity can be pointed out in the impugned order. The reasons recorded by the learned Trial Judge do not appear to be perverse. The petitioner prays for virtual interaction at this stage. If such prayer is made before the Court, the same shall be disposed of upon hearing all parties, strictly in accordance with law.

4. With the above observation, the revisional application being CO 3601 of 2025 stands disposed of.

5. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Shampa Sarkar, J.)
