Petitioner is directed to serve a copy of the revisional application upon Ms. Ratna Ghosh, learned advocate, who ordinarily appears on behalf of the State. Her appointment may be regularised by the concerned authorities.
Learned advocate appearing for the petitioner submits that the case was initiated in the year 1996 and charge-sheet was submitted in the year 1998. The examination of the prosecution witnesses are over but thereafter a recall was prayed for and the matter has been delayed. Last of such date was fixed on 5th October, 2023.
Having considered the fact that the case is pending for a period of 27 years, I direct that the learned trial court would conclude the prosecution evidence including the witnesses, if any, after recall within two months from the next date so fixed by the learned trial court. The learned trial court would thereafter within a month conclude the examination of the accused persons under
Section 313 of the Code of Criminal Procedure. The trial court would within two months thereafter pronounce its verdict in respect of S.T. No.2(4) of 2004 arising out of Habra Police Station Case No.59 of 1996.
With the aforesaid observations, CRR 3677 of 2023 is disposed of.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
