The present petitioner applied for the licence of FPS dealership in pursuance to the notification dated August 25, 2023 issued by the SCFS, Kandi, Government of West Bengal in respect of location for the vacancy Kandra, Daspara near Kali Mandir. It is that case of the petitioner that in pursuance to his application, the concerned authority has issued a notice for inspection at the proposed shop cum godown of the petitioner on December 13, 2023. On the same date, the inspection was conducted. However, the petitioner came to know from the online portal that his candidature was rejected.
He submitted a representation with the authority on August 27, 2024 and 2nd September., 2024 asking for reasons for rejection of his application. The
authority concerned has not respondent. None of his representations were considered. Hence, she approach before this Court.
The respondent no.6 appears before this Court and submits that in pursuance to the said notification, he applied for the vacancy and he was appointed by the concerned authority as successful candidate. Since two months, he is running the business after receiving the licence. Now, after the licence has been commissioned in favour of the respondent no.6, the present petitioner has no cause of action.
Mr. Dutta, learned counsel appearing on behalf of the State submits that the present petitioner's candidature must have turned down due to her ineligibility. However, Mr. Dutta is candid that no instruction has been received from the concerned authority.
Having heard for the parities, it appears to me that the petitioner has not stated anything adverse against the act and action of the state authority. However, the State authority must have considered the representations of the petitioner.
Under the above observation, the instant writ petition is disposed of with a direction to the petitioner to approach the concerned SCFS being respondent no.5 of the writ petition with a specific representation coupled with a copy of this order. So, that her required
information may be forwarded to the petitioner within a specific time. The SCFS concerned shall dispose of the representation of the petitioner within six weeks from the date of receiving; in disposing of the representation the respondent no.5 shall give the opportunity of hearing to the petitioner as well as the private respondent no.6 and shall dispose of the matter within six weeks and intimate the result within 2 weeks thereafter.
Under the above observation, the writ petition is disposed of.
