Mr. Joy Chakraborty ..for the petitioners Mr. L.M.Mahata Mr. Rudranil De ... for the State Affidavit of service filed by the petitioners and report submitted by the State are taken on record.

Though service upon the private respondents is not complete, the writ petition may be disposed of upon consideration of the report submitted by the State. It appears from the said report that a specific case has been started pursuant to the complaint submitted by the petitioners and charge sheet has been submitted therein. In the counter case filed by the private respondents investigation is complete and charge sheet has been submitted.

Learned counsel for the petitioners submits that they are restrained from entering their residential house by the private respondents for which they approached the police authorities several times but to no effect. The petitioners seek liberty to submit a comprehensive representation before the 3rd respondent ventilating their grievance.

In view of the above, the petitioners are granted liberty to submit a comprehensive representation before the 3rd respondent ventilating their grievance within seven days from date. The 3rd respondent is directed to consider the said representation and take necessary steps if required at the earliest, in accordance with law. Accordingly this writ petition is disposed of. Since no affidavit is called for, the allegations contained in the writ petition are deemed not to have been admitted.

There shall be no order as to costs.
