It appears from the Order No.63 dated 23rd June, 2023 that 24th November, 2023 was fixed for service of returns and acknowledgement due upon the defendant no.5.

The plaintiff was directed to take fresh steps in the meantime.

The learned advocate for the petitioners submits that though steps have already been taken pursuant to the order dated 23rd June, 2023, but the defendant no.5 is avoiding service of summons. Be that as it may, since the service of summons upon the defendant no.5 is not yet complete, no order for expeditious disposal of the suit can be passed at this stage.

CO 3362 of 2023 is disposed of by giving liberty to the petitioners to approach this court after service upon the defendant no.5 is completed. There shall be no order as to costs.

Urgent certified copy of this order, if applied for, be given to the learned advocates for the parties on usual formalities.
