Mr. Mukteswar Maity ...for the petitioners Affidavit of service filed is retained with the records. Despite service, none appears for the respondents. The petitioners pray for grant of benefit under the Abasan Yojna Prakalpa, 2017 and 2018. The petitioners claim to have made a representation dated September 20, 2019 to the Block Development Officer, Kulpi. From the Annexures of the writ petition it appears that the representation was made by the first petitioner only, Dilip Mondal. There is no representation from the end of the second petitioner, Hrishikesh Halder.

In view of the above, the instant writ petition is being allowed in respect of the first petitioner, Dilip Mondal only, and the writ petition is deemed to be dismissed as to the second petitioner.

The petitioner complains that his representation has not been considered by the Kulpi Block Development Officer till date.

As it appears that the representation of the petitioner is pending decision of the BDO, the instant writ petition is disposed of by directing the Kulpi BDO, the sixth respondent herein, to decide the same in accordance with law, within a period of three months from the date of

communication of this order. The said respondent shall pass a reasoned decision that shall be communicated to the petitioner immediately thereafter.

It is made clear that this court has not gone into the merits of the prayer of the petitioner and all points are left open to be decided by the said respondent at the time of consideration of the representation of the petitioner. [Amrita Sinha, J]
