C.R.M. (A) 4320 of 2023 08.01.2024 ML3 Court No.29 (AD) (Rejected) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Dantan Police Station Case No.448 of 2026 dated 16.12.2016 under Sections 395/397/412 of the Indian Penal Code, 1860 and read with Sections 25, 27 and 35 of the Arms Act, (G.R. Case No.4147 of 2016).

Ms. Faria Hossain Mr. Anand Keshari ... for the State.

The application for anticipatory bail is taken up for consideration subsequent to the order dated October 16, 2023 passed by the Coordinate Bench.

By such order, the interim anticipatory bail was granted to the petitioner.

It is submitted at the bar that such order was passed without considering the materials in the case diary and in view of the ensuing puja vacation.

Thereafter, the application was adjourned on January 2, 2024 on the prayer of the State.

We perused the materials in the case diary.

Today, learned Advocate appearing for the State submits that proclamation was issued as against the petitioner. The police case is dated December 16, 2016.

There are materials in the case diary suggests involvement of the petitioner.

In view of the long absconsion of the petitioner and the materials in the case diary and also in view of the proclamation being issued, we are unable to confirm the interim order dated October 16, 2023 or grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.

C.R.M. (A) 4320 of 2023 is dismissed.
