This matter was mentioned yesterday for correction of an order dated 30th January, 2024 upon notice to the other side.

It is submitted on behalf of the Union of India that due to lack of instruction, it could not be brought to the notice of this Court that the post of Deputy Chief Security Commissioner, R.P.F., Eastern Railway, Kolkata is presently lying vacant and the appeal can be heard by the Chief Security Commissioner, R.P.F., Eastern Railway, Kolkata.

By consent of the parties, the order dated 30th January, 2024 is modified to the aforesaid extent.

The said authority shall decide the matter in terms of the order dated 30th January, 2024.

Other directions passed in the order dated 30th January, 2024 shall remain unaltered.

6. The department shall make an endorsement that the appeal shall not be shown as pending.
