1. This instant writ petition has been filed by the writ petitioners seeking direction upon the respondents, their men, agents, servants, associates and each one of them and particularly the Secretary and President, West Bengal Board of Secondary Education, the respondent Nos. 6 and 5 herein, not to take any steps and/or further steps and/or proceed any further from appointment of Administrator and/or ad-hock committee as the case may in the Bonali D.C. Junior High School by superseding the existing Managing Committee forthwith.

2. None appears on behalf of either of the parties. No accommodation is sought for.

3. This case is pending since 2006, almost 19 years have passed.

4. At the time of admission of this instant writ petition, the Co-Ordinate Bench of this Court did not grant any interim order in favour of the petitioners and direction was passed to file affidavit-in-opposition to the writ application within two weeks from date and

affidavit-in-reply thereto, if any, be filed within one week thereafter.

5. Despite such direction, no affidavit-in-opposition and no affidavit-in-reply have been filed by the parties as yet, as revealed from the office report.

6. Prayer, as sought for, cannot be entertained as there is no scope to pass such order in favour of the petitioners after expiry of 19 years.

7. Therefore, this writ petition is devoid of merits.

8. Accordingly, this writ petition being WPA 23391 of 2006 is dismissed without any order as to costs.

9. All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court without insisting upon production of a certified copy thereof.
