WBBSE The writ petitioner is aggrieved by order dated 11.05.2015 by which the West Bengal Board of Secondary Education has refused to grant financial aid for running of the Kharagpur Arya Kanya Vidyalaya, Paschim Midnapore. The said school is functioning as unrecognised up to Class VIII. Thereafter students are sent for board examination to other schools.

The financial aid has been declined by the Board on the ground of the Control of Expenditure Act, 2005.

The Secretary of the Board in the impugned order has said that the aid may be granted NOC for affiliation and recognition of the government as an unaided school.

Insofar as the financial aid is concerned, this Court notes that there are a large number of minority

institutions enjoying financial aid from the State to some extent. The issue of financial aid to the said school is left open for being agitated before the State at a later stage with better particulars.

This Court, therefore, directs the West Bengal Board of Secondary Education to grant recognition to the said school in terms of its rules. Recognition shall be granted to the said school by the Board within one month from date. Existing rejection of financial aid in the impugned order shall not stand in the way of the petitioner's applying afresh for the same in future. The writ petition is disposed of.

There shall be no order as to costs.
