Case No. 14/2013 dated 05.01.2013 under Sections 302/34/120B/427 of the Indian Penal Code and Sections 25/27 of the Arms Act. And In the matter of: Koushik Paul @ Babai ....Petitioner Mr. Jisan Iqubal Hossain ...for the Petitioner Mr. Sudip Ghosh, Ms. Debjani Sahu ...for the State We have considered the materials on record. Statements of witnesses show that the petitioner had murdered the victim, who was an eyewitness in an earlier case registered against him. In view of the incriminating materials on record and the daring conduct of the petitioner, we are not inclined to grant bail to the petitioner at this stage.
In view of the protracted period of detention suffered by the petitioner, who is in custody for more than 9 years, we direct the trial court to conduct the trial as expeditiously as possible preferably within one year from the next date fixed for recording evidence without granting unnecessary adjournment to either of the parties.
