The instant revisional application has been filed under Section 482 of the Code of Criminal Procedure read with Section 483 of the Code of Criminal Procedure for expeditious hearing and disposal of the case No.GR-4821 of 2015 arising out of Noapara Police Station Case No.249 of 2015 dated 23.08.2015 under Sections 498A/406/323/506/34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act, pending before the learned 3rd Court of Judicial Magistrate, Barrackpore. The FIR was lodged on 23.08.2015 and the charge-sheet was filed on 30.09.2015. The cognizance was taken on 28.09.2016 and the next date for charge has been fixed on 21.10.2022. The learned Advocate for the petitioner submits that till date the charge has not been framed.
The certified copy of the Trial Court and the order sheets annexed with the application reveal the accused person on bail have been absent on several dates prolonging the trial and the disposal of the case.
The learned Trial Court is directed to take necessary steps for framing the charge, if not framed, as on date and expedite the hearing of the case and dispose it of by 31st December, 2023. Accordingly, the instant CRR No.3888 of 2022 is disposed of.
Let a copy of this order be communicated to the learned Trial Court.
