Learned counsel appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in this case. He has only acted as per instruction of another. Moreover, he has complied with the notice issued by the Investigating Officer.
Learned counsel appearing on behalf of the State relies on the case diary and the report and opposes the prayer for anticipatory bail. He submits that forged appointment letter was given to the de facto complainant by the present petitioner. Money was also taken by the petitioner on the pretext of giving job, which went to his account. His custodial interrogation is required for a proper investigation of the case. A prayer to add provisions regarding forgery has been approved by the concerned Magistrate.
Considering the incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.
Accordingly, the application for anticipatory bail of the petitioner is rejected.
