Petitioners are directed to serve a copy of the revisional application upon Mr. Imran Ali, learned advocate, who ordinarily appears on behalf of the State. His appointment may be regularised by the concerned authorities.

Learned advocate appearing for the petitioners submits that the petitioners were arrested on 2nd December, 2022 and till date they are in custody.

The prosecution has already submitted their chargesheet and the documents have already been supplied. The learned trial court has already overcome the stage of consideration of the charges and the next date is fixed on 11th December, 2023. The prosecution in order to prove its case has relied upon 12 witnesses. Having regard to the fact that 12 witnesses are to be examined and more than 10 months have expired in the meantime, I direct that the learned trial court would on and from the next date

so fixed be conscious regarding the factum of detention and exercise its discretion for fixing schedule at a regular intervals. No unnecessary adjournments should be granted to any of the parties. The public prosecutor conducting the case should ensure regarding the production of the materials, exhibits and documents available on the dates so fixed for examination of the witnesses. All stakeholders would co-operate with the learned trial court so that the trial is concluded at the earliest.

With the aforesaid observations, CRR 3678 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
