1. The appellant is not represented nor any accommodation is prayed for on behalf of the appellant.

2. The appeal is delayed by 67 days. However, considering the averments made in the application for condonation of delay disclosing sufficient ground, we condone the delay of 67 days in preferring the memorandum of appeal and the application for condonation of delay is disposed of.

3. In the absence of the petitioner, we have heard the learned Counsel for the parties.

4. Dr. Sutanu Kumar Patra, learned Counsel appearing for the West Bengal Central School Service Commission has fairly submitted that the Commission may consider the representation made by the appellant on 5th September, 2023.

5. Under such circumstances, we dispose of the appeal by directing the Chairman, West Bengal Central School Service Commission to consider the representation dated 5th September, 2023 in accordance with law within a period of eight weeks from date upon giving an opportunity of hearing to the writ petitioner.

6. With the above observations, the appeal and the applications are accordingly, disposed of.

7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
