1. The petitioner says that he has been falsely implicated. The First Information Report would show that the prosecution case is highly improbable. He is in custody for 130 days. He prays for bail.

2. We find that commercial quantity of contraband items was allegedly seized from a TOTO which was being driven by the petitioner. Investigation is in progress.

3. In that view of the matter, keeping in mind the restriction in Section 37 of the NDPS Act, we are not inclined to allow the petitioner's prayer for bail, at this stage.

4. The application for bail is, thus, dismissed. Signed By :
