1. The Deficit Court Fees of Rs.20/- has been put in vide document no. 2 on 26.02.2024.

2. Office is directed to tag the Court Fees with the memorandum of appeal.

3. Learned Counsel for the appellant submits that the instant appeal has been wrongly filed before this Court and, prays for withdrawal thereof.

4. In view of the above, the appeal being FMAT 433 of 2023 is dismissed as withdrawn.

5. Let the certified copy annexed with the memorandum of appeal be returned to the learned Advocate-on-record of the appellant by the Assistant Court Officer by replacement with a photocopy thereof.

6. However, withdrawal of the instant appeal shall not prevent the appellant in pursuing his remedy available under the law.
