Affidavit of service filed by the petitioner is taken on record.

The petitioner in the present writ petition is aggrieved by the inaction on the part of the respondent in not taking any action in stopping the alleged illegal and unauthorized construction taking place at LR plot no. 1377/3275 appertaining to LR Khatian no. 5478 and 5477 lying within Mouza Jamuria comprised in JL no. 21, ward no. 2, under the jurisdiction of Asansol Municipal Corporation. 3.

It is the case of the petitioner that he is the neighbouring land owner and has noticed the alleged illegal and unauthorized construction being carried out at the abovementioned premises.

He has submitted a

representation dated 19.9.2025, however no action has been taken.

Mr. Sounak Bhattacarya who usually appears for the Asansol Municipal Corporation is present in court. He is requested to appear in the matter on behalf of Asansol Municipal Corporation.

His engagement be regularized.

The present writ petition is disposed of with a direction to the respondent municipality to consider the petitioner's representation dated 19.9.2025 within a period of six weeks from the date of communication of this order strictly in accordance with law, after affording an opportunity of hearing to the petitioner as well as private respondent or any other stake holder, by way of speaking order.

Since no affidavit is called for, allegations made in the writ petition are deemed to have been denied. (Gaurang Kanth, J.)
