The petitioner's grievance is that the petitioner no. 1's land was acquired in 2010. The petitioner no.1 paid compensation for the same. Thereafter an application was made on behalf of the petitioner no.2 for employment as an Exempted Category (EC) candidate in the Land Loser category.

An application was made for such consideration in 2013. However, the same was not done in prescribed format. An application was made in proper format some time in August, 2023.

Ms. Samajpati, learned counsel appearing on behalf of the petitioners prays for enlistment of the petitioner no. 2's name in the Land Loser (EC) Category for employment with the Employment Exchange.

Mr. Basu, learned counsel appearing on behalf of the State respondents submits that the application has only been made in August, 2023. The prayer of the petitioners will be considered by the Additional District Magistrate (Land Acquisition), Nadia in accordance with law.

Considering the rival submissions of the parties and the materials placed on record, this Court is of the view that justice will be subserved by directing the respondent no. 6/ Additional District Magistrate (Land Acquisition), Nadia to consider the prayer for enlistment of the petitioner no. 2 in the Land Loser (EC) category within a period of twelve weeks from date. The decision of the respondent no. 6 will be communicated to the petitioners within two weeks of taking such decision.

With the aforesaid directions, WPA 22883 of 2023 is disposed of.

Since no directions have been passed for filing of affidavits, all the allegations contained in

the writ petition are deemed not to have been admitted by the parties.
