The petitioner alleges that though the complaint lodged by her has been registered and investigation initiated, she has not been examined till date under Section 183 of the BNSS, nor has any document in support of her allegation been collected/seized from her.

The petitioner seeks fair and appropriate investigation under the monitoring of a superior police officer.

Learned counsel for the State fails to apprise the Court why statement of the victim/petitioner has not been recorded under Section 183 of the BNSS till date. It is also not in dispute that the relevant documents relied upon by the petitioner and annexed to the writ petition have not

been collected by the investigating authority. Progress in investigation is far from satisfactory.

The investigating authority is directed to conduct the investigation in a fair, impartial and unbiased manner and take the same to its logical conclusion in accordance with law.

It is needless to mention that the investigating authority shall collect all the relevant documents relied upon by the petitioner and take all necessary steps to unravel the truth.

The investigation shall be monitored by the Assistant Commissioner of Police, Bijpur Division.

With the above observations and directions the writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
