The petitioner has relied upon the judgment passed by the Hon'ble Division Bench of this Court in MAT 1855 of 2025 dated 03.12.2025 wherein Hon'ble Appellate Court had remanded the matter back to the Court having determination to dispose of the writ in accordance with law after exchange of affidavit.

3. Learned counsel for the respondents has draws the attention of this Court that the prayer made in the writ application is against the police in action, thus this Court is not having the determination.

4. Accordingly, the matter is released from this Court with the liberty to the parties to mention the matter before the appropriate Court having determination.
