Mr. Debasis Kar, Mr. Arka Tilak Bhadra ...for the petitioners Mr. Kapil Guha ...for the State Mr. Soumyajit Bhatta ....for the respondent no. 4 The Khardah Police Station has filed a further report dated March 20, 2023, which is taken on record.

The petitioners' grievance against the private respondents is that they are obstructing ingress and egress to the petitioners' shop room cannot be addressed by the police or the writ Court.

If the private respondents obstruct his ingress and egress, the remedy of the petitioner is before an appropriate civil or statutory forum.

The police further indicates that there was earlier dispute with regard to throwing of garbage in front of the petitioners' shop room. The same was addressed and proceedings under Section 107 of the

Cr. P.C. have been taken out against the private respondent nos. 5, 6 and 7 by the Khardah Police Station on October 18, 2022.

This Court finds no inaction on the part of the Khardah Police Station. The police shall, however, ensure that there is no nuisance or breach of peace around the petitioners' premises.

Regular vigil shall be maintained on the said premises by the police.

With the aforesaid observations, W.P.A. 23232 of 2022 shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
