The grievance of the petitioner does not survive in the facts and circumstances which have been elaborated by the learned advocate for the West Bengal State Electricity Distribution Company Limited.

The first contention of the distribution company is that no permanent connection has yet been given to Naba Kumar Maity, the respondent no.5 herein. The second contention is that in the 23rd meeting of the District Level Ground Water Resources Development Authority, it was resolved that Pataspur-I block would be a safe zone. In the district of Purba Medinipur, there was a categorization of the blocks. As per the assessment report which was approved by the State Level Committee and the Central Level Expert Group, certain safe zones were segregated.

The writ petition relates to Pataspur-I block, which had been identified as a safe zone. According to the authorities, there would be no impediment in granting connection to the submersible pumps in the said block and the minimum distance of 200 metres between two submersible pumps was not required to be maintained.

It is further contended that the prayer of the petitioner to transfer the connection to his name on the death of his father, would be considered only if the petitioner applied in the prescribed form and complied with necessary formalities. 5.

The Assistant Engineer and Station Manager, Amarashi Customer Care Centre has already intimated the petitioner that the objection of the petitioner would be considered if permanent connection is granted to Naba Kumar Maity. The authority will issue a letter to the petitioner, intimating him about the decision of the State Level Committee and the approval of the Central Level Expert Group.

With regard to the petitioner's prayer for transfer of the name, the petitioner will act and proceed in accordance with law.

The writ petition is disposed of accordingly. The minutes of the 23rd meeting of the District Level

Ground Water Resources Development Authority is taken on record.

All parties are directed to act on the basis of the server copy of the order.
