Heard learned advocate for the opposite parties. It appears from the record that by an order dated 14th October, 2022 this court directed that the status quo to be maintained by both the parties in respect of nature and character and possession of the suit property as on the said date till the disposal of the injunction application pending before the learned trial court.

Mr. Chowdhury, learned advocate appearing for the opposite parties submits that the status quo order may remain but as the learned court below is not proceeding with for hearing of the injunction application as because of the matter

is pending before this court, thus, necessary direction may be issued.

In the facts and circumstances of the case, this revisional application stands disposed of. Parties are directed to maintain status quo till the disposal of the temporary injunction application in Title Suit No. 265 of 2022 pending before the learned Civil Judge (Senior Division), 1st Court at Baruipur, South 24 Parganas.

Learned trial judge is requested to dispose of the said temporary injunction application within a period of 5 weeks from the next date fixed.

It is clarified that this court has not gone into the merits of the matter.

It is, further, clarified that the consent given by the opposite parties is only for the purpose of this revisional application and it should not be treated as consent in the suit before the learned court below which will be disposed of on merits. ( Biswaroop Chowdhury,J. )
