Petitioner is directed to serve a copy of the revisional application upon Ms. Amita Gaur, learned advocate who ordinarily appears on behalf of the State. Her appointment may be regularized by the concerned Authorities in due course. Learned advocate for the petitioner has drawn the attention of this court to the allegations made in the FIR as well as the chargesheet which have been submitted in connection with the instant case.
Learned advocate submits that so far as the present petitioner, Napisa Khatun @ Nafisa Bibi is concerned, neither specific allegation has been made against her nor she is involved in the issue relating to assault as is reflected from the letter of complaint or the chargesheet.
I have considered the submissions advanced on behalf of
the petitioner and I find that the petitioner is yet to receive the documents under Section 207 of the Code of Criminal Procedure. Accordingly, I am of the view that the present revisional application is premature. Petitioner would be at liberty to take up the issues at the stage of consideration of charges by preferring an application in the nature of Section 227 of the Code of Code of Criminal Procedure.
Learned trial court would consider the issues canvassed by the petitioner without being influenced by any observations made by this court while disposing of this revisional application. . With the aforesaid observations, the present revisional application being CRR 3686 of 2023 is disposed of. Pending applications, if any, are consequently disposed of.
