The petitioner is aggrieved by the manner in which Durgapur P.S. case no.490 of 2022 dated 13.10.2022 is being investigated by the Inspector of Police, Cyber Crime Police Station.

The grievance of the petitioner is that on August 31, 2022 the offence was committed and it is only on October 13, 2022 the case has been registered. The police authorities are expected to be prompt in such cases in view of the decision of Hon'ble Supreme Court in Lalita Kumari. However, the case has been finally registered with Cyber Crime Police Station.

Having regard to the nature of the offences alleged and the direction being passed by the Learned ACJM Durgapur, I direct that Deputy Commissioner in charge of

Cyber Crime Police Station, Asansol-Durgapur Police Commisssionerate will monitor the investigation and submit a report regarding the progress before the Learned ACJM, Durgapur on or before October 31, 2022. All efforts must be made by the investigating agency to unearth in respect of allegations regarding the fraud committed. Learned ACJM, Durgapur is directed to abide by the direction passed in Sakiri Vasu -vs- State of U.P. reported in (2008)2 SCC 409.

Report filed by the State be kept with the record. With the aforesaid observations, WPA 23242 of 2022 is disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
