Jahangir Ali Sekh And ORS v. Devalok Developers Ltd
19.10.2022 Sl.No. 1 sn C.O.3256 of 2022 Jahangir Ali Sekh & Ors.
Vs.
Devaloke Developers Limited Mr. Sanjib Bandopadhyay Mr. Ashok Kr. Singh ..for the petitioners Mr. Rudrajib Chowdhuri Mr. K.N. Jana ..opposite party The petitioners have come up by filing this revisional application to challenge the impugned order dated July 4, 2022 passed by the learned Civil Judge (Senior Division), 2nd Court, Baruipur. By the dint of the said order, the Court has vacated the interim order of injunction, earlier granted by the learned trial Court in favour of the present petitioners. Against the petitioners, it has been forcefully argued that the impugned order is an appealable one and the petitioners could not have come up with the present petition which is not maintainable in the eye of law. Suffice to say that the injunction petition of the present petitioners is presently pending before the learned trial Court and also that the petitioners are not protected with any order of injunction as such, right now.
Under such circumstances, I am inclined to dispose of this revisional application with the direction that the learned trial Court shall take all possible endeavours to dispose of the injunction
petition of the present petitioners within the month of November,2022 without granting any unnecessary adjournment to any of the parties.
All parties are to act on the basis of the server copy of this order.
